1. SCOPE
In this policy, « Leclerc », « we », « our » or « us » mean Biscuits Leclerc Ltd and companies of the same corporate group.
This policy applies to users of the Leclerc Web site, consumers, individuals entering our premises, business partners and other persons (other than Leclerc employees) who communicate with us.
Leclerc is committed to protecting your privacy and ensuring the confidentiality of your personal information. The purpose of this policy is to describe the principles and rules of governance as well as our practices regarding the collection, use, communication, retention and protection of your personal information. It also explains your rights with respect to your personal information. It has been drawn up in accordance with the requirements of the Act respecting the protection of personal information in the private sector (Québec) and its associated regulations.
Users of our website should read this policy in conjunction with our Website Policy.
By browsing our website, subscribing to our newsletter, visiting our premises, communicating with us or conducting business with Leclerc, you are deemed to accept our privacy practices as described in this policy.
Third-party websites and applications that you may access by clicking on a link on the Leclerc website are not covered by this policy. These third-party sites and applications are subject to each third party’s own privacy policies. Leclerc assumes no responsibility for the collection and processing of your personal information by such third-party websites or applications.
2.PERSONAL INFORMATION WHICH MAY BE COLLECTED
Leclerc may collect, use, retain and disclose personal information, i.e. information that directly or indirectly identifies you as an individual, such as :
– information about your identity, such as your first and last name, number or copy of a driver’s license, passport or other identification document;
– contact information such as your personal e-mail address, personal telephone number and residential address;
– information about your age or date of birth, such as your date of birth to validate that you are of legal age to use our website or services;
– information about your communication and marketing preferences, such as your food preferences;
– employee and business partner recruitment information, such as your resume, education, training, employment history, professional affiliations, work permits, credentials and other relevant information;
– financial or billing information such as a billing address or bank account information;
– images of you such as a photo or video if you are on our property or in our facilities;
– any other information that may be necessary to process a request, or particular request, that you voluntarily provide to us.
Your name and business contact information, i.e. your business title, address, telephone number and e-mail address, are not personal information. In addition, personal information that has been anonymized by removing details that no longer identify you is no longer personal information.
We do not knowingly collect or use personal information from children under the age of 14 without the prior consent of a parent or guardian. If, as a parent or guardian, you discover that your child has provided us with personal information, you may request that this information be deleted from our records by contacting us at the coordinates listed below.
3. PURPOSES OF PERSONNAL INFORMATION COLLECTION
Leclerc collects personal information in order to manage and carry out its activities, in particular to:
– To promote our products and services and provide information about them;
Conduct contests and surveys and contact the winners;
To send our newsletter to subscribers;
– Manage the use and effectiveness of our website and offer relevant content to users;
– MANAGE CONSUMER REQUESTS AND COMMENTS RELATED TO OUR PRODUCTS;
– Recruit personnel, including assessing applications for compliance with job requirements;
– Engaging business partners and managing the business relationship, including validating banking information for payments, ensuring that suppliers’ employees have the licenses, training and credentials required to perform services (the supplier must obtain the consent of its employees before sharing this information with us), and complying with our contractual and legal obligations);

– For research and development purposes, to understand consumer expectations and adapt our products and services accordingly;
– To comply with our legal obligations, for risk management purposes or for investigative purposes, for example, in the event of a suspected breach of the law or of our policies and procedures; and
– For any other purpose consistent with the above.
4. MEANS FOR COLLECTING PERSONAL INFORMATION
We collect personal information in a number of ways, including verbally, in writing or electronically, via our website’s “Contact Us” feature, Facebook Messenger, by telephone, text message, e-mail, mail or in person. Collection occurs when you use our website, when you voluntarily communicate with us (for example, by subscribing to our newsletter, sending us a question about a product or applying for a job), or as it relates to our business partners, at the time of the engagement process and throughout the business relationship.

5.LIMITS ON COLLECTION, USE AND DISCLOSURE OF PERSONAL INFORMATION
We collect only the personal information we need for the purposes for which it was collected. We cannot use your personal information for purposes other than those to which you have consented, nor disclose it to a third party without your consent. Only certain authorized persons may consult your personal information in the course of their duties.
6.DISCLOSURE OF PERSONAL INFORMATION
The information you provide may be shared with, or transferred to, other companies of the Leclerc Group operating in Canada, the United States or elsewhere. We also reserve the right to communicate it to any successor of the company in the event of a sale of our assets, a merger or a restructuring, subject to our legal obligations.
We will not disclose your personal information to any third party except as described in this policy and only to the extent necessary for the third party to perform services on Leclerc’s behalf. 7.TRANSFER OF PERSONAL INFORMATION OUTSIDE QUEBEC
We may use service providers located outside the province of Quebec, including in the U.S., for data hosting, archiving and software services. Personal information may transit, be transferred or stored in cloud environments or outside the province or state of your residence or the place of business of our business partners. In such cases, personal information may be subject to the applicable legal regime of the location where the information is transferred and stored. If the transfer originates in the province of Quebec, it must be made in accordance with the provisions of the law applicable in Quebec. However, privacy laws in other jurisdictions or countries may not be as stringent as in Quebec. Leclerc will comply with the requirements of the General Data Protection Regulation regarding the transfer of personal information between the European Union and the third country, if applicable (“GDPR”).
8. ACCURACY
We take reasonable steps to ensure that your personal information is accurate and complete for the purposes for which it was collected, used or disclosed. To help us keep our records as complete, accurate and up-to-date as possible, please inform us in a timely manner of any changes to your personal information, such as a change to your e-mail address or other information you have provided to us
9. RETENTION OF INFORMATION
We keep your personal information only as long as it is necessary or useful for the purposes for which it was collected, or as required by law.
We destroy such information in accordance with the law and our personal information retention and destruction schedule. When we destroy your personal information, we take the necessary steps to ensure that confidentiality is preserved. In certain cases where we have a serious and legitimate reason to do so, we may retain certain files that have previously been anonymized, i.e. that no longer allow you to be identified, for legal, administrative, governance or compliance purposes.
10.ACCOUNTABILITY US
We are responsible for protecting personal information in our possession or custody from unauthorized use or disclosure, loss, and any other action that may compromise the confidentiality of the information, regardless of the format in which it is held.
We are also responsible for the information we entrust to third parties for processing. We require these suppliers to protect this information according to strict confidentiality and security standards. Moreover, when these suppliers are private companies doing business in Quebec, they are subject to the same obligations of confidentiality and protection of personal information as we are, as set out in the Act respecting the protection of personal information in the private sector.
The Privacy Officer oversees this Privacy Policy and is also responsible for the development and implementation of a governance framework and procedures for the protection of personal information.
We also provide information and training to our employees to ensure they are adequately trained in our privacy policies and practices.
11.SECURITY MEASURES
We have implemented rigorous security measures suited to the sensitivity of personal information to ensure that it remains strictly confidential and is protected against unauthorized access, disclosure, or use, as well as against loss or theft. These security measures include organizational, physical, technological, and contractual measures.
It should be noted that no method of Internet transmission or data storage is totally secure. Therefore, we cannot guarantee the absolute security of personal information always transmitted to us by these methods, and we ask you to avoid, if possible, transmitting particularly sensitive information to us by these means. In all cases, you make any such communication with full knowledge and at your own risk.
12.REQUEST FOR ACCESS, RECTIFICATION AND DELETION; RIGHT TO WITHDRAW CONSENT
You have the right to know whether we hold personal information about you, and to access that information. You may verify the accuracy and completeness of your personal information and request that it be corrected or updated, if necessary. You also have the right to ask questions about how this information was collected and used, and to whom it was disclosed, unless an exception is provided for by law.
You may also request that we delete your personal information and you may withdraw your consent to the use or disclosure of your personal information at any time, subject to certain legal or contractual restrictions.
All requests must be made in writing to the Privacy Officer whose contact details are given in the section below. It will be processed as soon as possible, but no later than 30 days from the date of receipt of the written request. If we are unable to provide you with access to all the personal information we hold about you, we will inform you of the reasons why. We may charge a reasonable fee to process your request if we incur such a fee.
Your request to delete certain information or your withdrawal of consent may affect our ability to respond to your request or to provide you with certain services. If so, we will inform you of the impact and record your decision in our files. In addition, if we believe we have legitimate reasons to do so, we may retain certain information for a reasonable period of time in order to meet our legal obligations or anonymize it to the extent permitted by law.

14.APPLICABLE LAW; LANGUAGE
This Policy shall be governed by and construed in accordance with the laws of Canada and the Province of Quebec. The courts located in the district of Quebec will have exclusive jurisdiction over any dispute relating to this policy. The English and French versions of this policy have the same legal value.
15.EFFECTIVE DATE AND AMENDMENTS

It will be reviewed every three years from the date of adoption, or more frequently in the event of a significant change in applicable laws and to reflect our practices. This Website Use Policy contains information about Leclerc’s use of cookies, links to social networking modules and external websites, and use of aggregate information on its website. It should be read in conjunction with our Privacy Policy.
